You agree not to participate as a plaintiff or class member in any purported class action, collective action, representative action, mass action, or private attorney general proceeding.
The parties expressly waive any right to bring or participate in such actions to the fullest extent permitted by law.
If any portion of this Class Action Waiver is found unenforceable, the remaining provisions of these Terms shall remain in full force and effect.

16. Termination

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely.
